Prenuptial agreements, also known as premarital contracts, are contracts made prior to marriage to protect the pre-marital assets of the parties in the case of divorce. They may also include provisions regarding the forfeiture of marital assets in the case of adultery, abuse, etc. However, they may not include provisions related children born of the marriage, as those decisions must be decided later, taking into account the best interests of the child.
To be valid in Virginia, Prenuptial Agreements must be:
- in writing,
- signed by both parties,
- not in violation of public policy or criminal statute,
- not unconscionable when executed,
- and both parties must be fully informed of the other’s financial obligations, or must waive such a disclosure in writing.
